I'm still thinking that if the donations are OPTIONAL and you don't get any guarantees in return, it qualifies as a gift. I'll have to study my law book some more to be sure though... Contractual stipulations expressly forbidding donations without a license could always be made part of an End User License Agreement entirely separate from a copyright.
