How about this, then...

Establish two, separate companies.  One for profit and one not-for-profit.
The first company is a technical production house creating software that
provides you with the material necessary to play certain games - sort of
like NVN.  The second company is a nfp entertainment group.  The first
company makes and designs the materials required to access and play games
with your friends - the equivalent of TSR selling AD&D books.  The company
also charges a $10/month licensing fee, that entitles you to free updates.
The second company runs a gaming collective, owning and managing a central
server for a group of people who opt to play together.  This company also
operates a volunteer force of specific players who wish to help run the
collective.  To make things even more official, the second company purchases
the server side toolkit from the first company, and pays a licensing fee for
the right to run a server.  The nfp company can recoup these costs by
selling advertising - always ensuring to maintain zero net gain.

Can anyone with more knowledge of business law explain whether or not this
would work?
